The Bombay High Court has held that child in Conflict with law can also file anticipatory bail under section 438 of Cr.P.C. 1973.
The JJ Act doesn’t contain any specific provision for anticipatory bail. The Bombay High Court in the case of Raman Mundhe and Anr. v. State of Maharashtra has held that in the absence of in absence of provisions governing grant of anticipatory bail under the Juvenile Justice (Care and Protection of Children) Act [JJ Act], a juvenile in conflict with law can file an anticipatory bail application under Section 438 of the Code of Criminal Procedure (CrPC).
