मामले के तथ्य
Dahyabhai Chhaganbhai Thakkar अपनी पत्नी Kalavati के साथ रहते थे। दोनों का विवाह 1958 में हुआ था।
9 अप्रैल 1959 की रात दोनों अपने कमरे में सो रहे थे। कमरे का दरवाजा अंदर से बंद था। पड़ोसियों ने Kalavati की चीखें सुनीं। जब लोगों ने दरवाजा खुलवाया, तो Dahyabhai ने दरवाजा खोला और Kalavati गंभीर रूप से घायल अवस्था में मिलीं। बाद में उनकी मृत्यु हो गई। (Studocu)
Dahyabhai पर अपनी पत्नी की हत्या का आरोप लगाया गया और Section 302 IPC के तहत prosecution हुआ।
उनका मुख्य defence था कि वे unsoundness of mind से पीड़ित थे और हत्या के समय उन्हें अपने act की nature या यह समझ नहीं थी कि उनका act wrong या contrary to law था।
Trial Court ने insanity का defence स्वीकार नहीं किया और उन्हें murder के लिए दोषी ठहराया।
मामला अंततः Supreme Court पहुंचा।

सबसे महत्वपूर्ण Principle: Burden कभी पूरी तरह Prosecution से नहीं हटता
Supreme Court ने कहा कि:
Prosecution का general burden हमेशा prosecution पर रहता है।
अर्थात prosecution को accused की guilt beyond reasonable doubt सिद्ध करनी होती है।

लेकिन:
Prosecution का मूल burden shift नहीं होता।
Insanity Defence में Burden of Proof
यह judgment examination के लिए अत्यंत महत्वपूर्ण है।
Section 105 Evidence Act के कारण insanity की circumstances को establish करने का burden accused पर था।
लेकिन Supreme Court ने स्पष्ट किया कि accused का burden prosecution के burden जितना कठोर नहीं है।

इस स्थिति में accused को necessarily यह साबित करने की आवश्यकता नहीं कि insanity निश्चित रूप से सिद्ध हो गई है।

Insanity का Relevant Time
Insanity defence में सबसे महत्वपूर्ण समय है:
जब अपराध वास्तव में किया गया था।
इसलिए यह पर्याप्त नहीं है कि accused:
- अपराध से पहले कभी mentally ill था; या
- अपराध के बाद mentally ill हो गया।
Court को मुख्यतः यह देखना होता है कि offence के समय उसकी mental condition क्या थी।

Medical Insanity और Legal Insanity

Medical Insanity
व्यक्ति किसी मानसिक बीमारी या psychiatric condition से पीड़ित हो सकता है।
Legal Insanity
Criminal law में प्रश्न यह है कि उस mental condition के कारण offence के समय accused अपने act की nature या उसके wrong/contrary-to-law character को समझने में incapable था या नहीं।
इसलिए केवल medical diagnosis अपने आप Section 84 का defence स्थापित नहीं करता।
