Mens Rea और Statutory Offences में Presumption Against Strict Liability

यह एक English authority है, इसलिए भारतीय न्यायालयों में यह binding precedent नहीं है। इसका महत्व मुख्यतः mens rea और statutory interpretation के criminal-law principle के रूप में है।

परिचय

Sherras v. De Rutzen criminal law में mens rea की presumption स्थापित करने वाले प्रमुख English cases में से एक है। Court ने माना कि किसी statutory offence में legislature ने mens rea को स्पष्ट रूप से exclude नहीं किया है, तो सामान्यतः Court को यह मानना चाहिए कि guilty mind आवश्यक ingredient है।


मामले के तथ्य

मामले में एक licensed publican ने एक व्यक्ति को शराब बेची।

कानून के अनुसार कुछ परिस्थितियों में publican द्वारा शराब बेचना prohibited था, विशेषकर जब purchaser की स्थिति ऐसी हो कि कानून के तहत उसे शराब बेचना निषिद्ध हो।

आरोपी का बचाव यह था कि उसे उस factual circumstance की जानकारी नहीं थी जिसके कारण sale prohibited हो गई थी।

मुख्य प्रश्न यह था कि क्या केवल prohibited act कर देना conviction के लिए पर्याप्त है या prosecution को accused की knowledge या mens rea भी साबित करनी होगी।


मुख्य कानूनी मुद्दा

मुख्य प्रश्न था:

क्या statutory offence में mens rea को impliedly आवश्यक माना जाना चाहिए, जब statute ने expressly यह नहीं कहा है कि guilty mind आवश्यक है?


Court का निर्णय

Queen’s Bench Division ने accused के पक्ष में निर्णय दिया।

Court ने criminal statutes की interpretation के संबंध में यह महत्वपूर्ण principle बताया कि:

Mens rea को सामान्यतः statutory offence में presume किया जाना चाहिए, जब तक statute की language, subject matter या necessary implication यह न दिखाए कि legislature ने इसे exclude किया है।

Mens Rea की Presumption

यह case मुख्यतः इसी principle के लिए प्रसिद्ध है।

Criminal law में सामान्यतः:

Actus Reus + Mens Rea = Criminal Liability

इसलिए यदि statute किसी prohibited act को offence बनाता है, तो Court ordinarily यह presume करेगा कि legislature ने व्यक्ति को guilty mind के बिना punish करने का इरादा नहीं किया, जब तक contrary legislative intention दिखाई न दे।

Strict Liability इसका Exception है

Court ने यह नहीं कहा कि प्रत्येक statutory offence में mens rea अनिवार्य है।

इसके विपरीत, Court ने माना कि कुछ offences strict liability offences हो सकते हैं।

इसलिए interpretation का सही approach है:

पहले Mens Rea की presumption

↓

फिर Statute की language और object देखें

↓

यदि legislature ने mens rea exclude किया है → Strict Liability संभव

यह principle बाद की criminal jurisprudence में अत्यंत प्रभावशाली रहा।


तीन परिस्थितियाँ जहाँ Mens Rea को Exclude किया जा सकता है

Sherras v. De Rutzen से जुड़ी judicial discussion में यह महत्वपूर्ण विचार मिलता है कि mens rea को exclude करने के लिए केवल statute में “knowingly” शब्द का होना या न होना निर्णायक नहीं है।

Court को विशेष रूप से देखना चाहिए:

Statutory wording

क्या statute की भाषा mens rea को exclude करती है?

Subject matter

क्या offence public welfare, licensing, public safety या regulatory control से संबंधित है?

Consequences

क्या strict liability impose करना legislative purpose को पूरा करता है?

इन factors से यह determine किया जाता है कि offence mens rea वाला है या strict liability वाला।


Regulatory Offences का महत्व

Licensing और public welfare statutes में legislature कभी-कभी strict compliance चाहता है।

ऐसे मामलों में accused की subjective intention से अधिक महत्वपूर्ण हो सकता है कि statutory prohibition का उल्लंघन हुआ या नहीं।

लेकिन केवल यह तथ्य कि offence regulatory है, अपने आप mens rea को समाप्त नहीं करता।

Statutory intention का analysis आवश्यक है।

State of Maharashtra v. Mayer Hans George से संबंध

State of Maharashtra v. Mayer Hans George, AIR 1965 SC 722 के साथ यह case बहुत महत्वपूर्ण comparative study बनाता है।

Sherras v. De Rutzen

Presumption: Mens rea ordinarily required.

Exception: Legislature ने स्पष्ट रूप से या necessary implication से mens rea exclude किया हो।

Mayer Hans George

Supreme Court ने भारतीय regulatory/economic legislation के संदर्भ में माना कि statute की scheme और object से mens rea को exclude किया जा सकता है।

इसलिए दोनों judgments का common theme है:

Mens rea सामान्य नियम है; strict liability exception है।


Queen v. Tolson से संबंध

R. v. Tolson, (1889) 23 QBD 168 में honest और reasonable mistake of fact के context में mens rea पर विचार हुआ।

Sherras v. De Rutzen (1895) 1 QB 918 ने statutory offences में mens rea की presumption को और स्पष्ट किया।

दोनों को साथ पढ़ने पर:

Tolson → Mistake of Fact + Mens Rea

Sherras → Statutory Offences + Presumption of Mens Rea

Mayer Hans George → Mens Rea का Statutory Exclusion + Strict Liability

यह criminal jurisprudence के लिए एक उपयोगी doctrinal chain है।


भारत में इसका महत्व

Sherras v. De Rutzen भारतीय न्यायालयों के लिए binding authority नहीं है, लेकिन Indian criminal-law textbooks और jurisprudence में mens rea के historical development को समझने के लिए इसका महत्व है।

भारत में आज Bharatiya Nyaya Sanhita, 2023 (BNS) लागू है।

BNS की कई offence provisions में mental element को अलग-अलग शब्दों में व्यक्त किया गया है, जैसे:

intentionally

knowingly

voluntarily

dishonestly

fraudulently

इसलिए प्रत्येक offence में applicable statutory language को देखना आवश्यक है।

सिर्फ यह कहना कि “हर अपराध में mens rea आवश्यक है” पर्याप्त नहीं होगा।

Mens Rea की Presumption

Statutory offence में सामान्यतः mens rea को presumed किया जाता है।

Strict Liability Exception है

Strict liability को सामान्य rule नहीं माना जाता; उसे statutory language या necessary implication से establish करना होता है।

Statutory Intention महत्वपूर्ण है

Court को statute की language, object और subject matter देखकर legislature की intention निर्धारित करनी चाहिए।

Regulatory Nature Alone निर्णायक नहीं

किसी offence का regulatory होना अपने आप mens rea को exclude नहीं करता।

निष्कर्ष

Sherras v. De Rutzen, [1895] 1 QB 918 criminal law में mens rea की presumption के लिए एक classic authority है। इसका मूल सिद्धांत यह है कि यदि legislature ने किसी act को statutory offence बनाया है, तो Court सामान्यतः यह presume करेगा कि guilty mind आवश्यक है, जब तक statute की language, subject matter या necessary implication इसके विपरीत न हो।

इसीलिए यह case strict liability के exception को समझने के लिए भी महत्वपूर्ण है। भारतीय संदर्भ में इसे State of Maharashtra v. Mayer Hans George और Nathulal v. State of Madhya Pradesh के साथ पढ़ना विशेष रूप से उपयोगी है।

Sherras v. De Rutzen (1895) ने statutory criminal offences में mens rea की सामान्य presumption को मजबूत किया। Strict liability तभी स्वीकार की जानी चाहिए जब legislative intention से mens rea का exclusion स्पष्ट हो।
